THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

At Custom Care Compounding Pharmacy, protecting your privacy is an important part of the care we provide. This Notice explains how we use and protect your health information, your rights regarding that information, and how you can contact us with questions or concerns.

OUR RESPONSIBILITY TO YOU

We are required by law to:

  • Maintain the privacy and security of your protected health information (“PHI”)
  • Provide you with this Notice describing our legal duties and privacy practices
  • Follow the terms of this Notice currently in effect
  • Notify you if a breach occurs that may compromise your information

We only use or share your health information as permitted or required by law and apply the minimum necessary standard, meaning we limit information shared to only what is needed to perform our duties.

WHAT IS PROTECTED HEALTH INFORMATION (PHI)?

Protected Health Information includes information that identifies you and relates to:

  • Payment for healthcare services
  • Communications between you, your prescriber, and our pharmacy

This information may exist in electronic, written, or verbal form.

We use and share your information to safely prepare and dispense medications and coordinate care.

  • Communicating with your prescriber about prescriptions
  • Clarifying dosing or formulation details
  • Counseling you about medications

At our pharmacy:

  • Patients typically pay directly by credit card or other payment methods.
  • Receipts include prescription numbers but do not list medication names.
  • Detailed (“long-form”) receipts containing ingredient information are provided only upon patient request, typically for reimbursement purposes.

We may use information to operate and improve our pharmacy, including:

To protect your privacy, we limit information shared electronically whenever possible. For example, text messages may reference medications using abbreviated naming rather than full drug names.

You may request alternative communication methods at any time.

  1. Family Members, Caregivers, and Authorized Pickups

We may release limited information to individuals involved in your care or payment, including caregivers or family members picking up prescriptions, unless you instruct us otherwise.

  1. Shipping Medications

We ship medications directly to patients within California. Shipping labels do not contain medication information and are designed to protect your privacy.

  1. Business Associates

We work with trusted vendors who help us operate our pharmacy. These companies are required to protect your information under HIPAA agreements.

Examples include:

  • Pharmacy software systems
  • Payment processors
  • Shipping and logistics providers

Only the minimum information necessary is shared.

We may disclose information when required by law, including:

  • California Board of Pharmacy requirements
  • FDA reporting obligations
  • Public health reporting
  • Law enforcement requests meeting legal standards

HOW COMPOUNDING PHARMACIES DIFFER FROM CHAIN PHARMACIES

Custom Care Compounding Pharmacy prepares customized medications tailored to individual patient needs based on prescriber instructions.

Unlike large chain pharmacies:

  • Medications are individually formulated rather than mass-manufactured.
  • We often work closely with prescribers to adjust strengths, dosage forms, or ingredients.
  • We collect only information necessary to safely prepare personalized medications.
  • Many prescriptions require pharmacist-prescriber collaboration to ensure safety and effectiveness.

Because of this individualized process, limited information sharing between the pharmacy and prescriber is sometimes necessary to ensure accurate preparation and patient safety.

OUR MINIMAL DATA COLLECTION PHILOSOPHY

We intentionally limit the information we collect and share.

We:

  • Collect only information necessary to safely dispense medications
  • Avoid including medication names on receipts when possible
  • Use generic shipping labels
  • Limit electronic communications to the minimum necessary details
  • Restrict access to patient information to authorized staff only

Our goal is to protect your privacy while still providing safe, effective pharmacy care.

YOUR RIGHTS REGARDING YOUR HEALTH INFORMATION

You have the right to:

Request Access

Obtain a copy of your pharmacy records, usually within 30 days.

Request Corrections

Ask us to correct information you believe is inaccurate or incomplete.

Request Confidential Communications

Ask us to contact you in a specific way (for example, phone instead of text).

Request Restrictions

Ask us not to share certain information. We will comply when legally possible.

Receive an Accounting of Disclosures

Request a list of certain disclosures we have made of your information.

Receive a Paper Copy

You may request a paper copy of this Notice at any time.

OUR DUTIES IN THE EVENT OF A BREACH

If a breach occurs that may compromise your protected information, we will notify you promptly by mail and, when appropriate, by phone, as required by law.

CHANGES TO THIS NOTICE

We reserve the right to change this Notice at any time. Updated versions will be available:

  • Upon request

The revised Notice will apply to all information we maintain.

We will request that patients acknowledge receipt of this Notice as required by law. Refusal to sign does not affect your ability to receive services.
